However, in the Occidental Worldwide Investment Corporation v Skibs (The Sibeon The Sibotre)[1976] 1 Lloyds Rep 293 case, the principle of economic duress was taken in consideration for the first time and thus this case acted as a landmark decision in this regard. It essentially refers to the presence of economic pressure for compelling the party into agreement with demands that it would not have otherwise agreed to (Lindgren, 2011). The various elements of economic duress are highlighted below (Gibson Fraser, 2014). There is presence of wrongful threat which includes the threat of breaching contract to be executed in bad faith. There is no alternative available for the party but to agree with the demands of the other party. The threat effectively amounts to enactment of the contract which takes into consideration the situational factors. Financial distress is brought upon the other party. A relevant case in this regard is North Ocean Shipping v Hyundai Construction (The Atlantic Baron)[1979] QB 705. As per this case, the claimant entered into a contract with the defendant for building a ship for a specified amount in USD. Post the contract enactment, there was a devaluation of the USD by 10% which enhanced the cost for the builder (i.e. defendant). The defendant asked for additional 10% payment from the claimant and threatened to breach the contract in case of non-compliance with the request. Meanwhile, the claimant had got an attractive charter for the ship and therefore needed that the ship be delivered on time. As a result, the claimant reluctantly agreed to the defendants request. However, after eight months had elapsed from the date of delivery of ship, the claimant initiated legal proceedings to recover the excess payment made earlier (Carter, 2012). The judge opined that indeed there were elements of economic duress and hence it was voidable but the fact that c laimant had delayed their claim for so long implies that have effectively provided confirmation to the contract (Harvey, 2009). Hence, the claimant could not recover the excess payment made under duress. Application In the given case, North Ocean Tankers entered into a contract with a shipbuilder for the building of tanker. The contract price was negotiated in USD and the contract did not have any clauses dealing with currency fluctuation. After the execution of contract, the USD was devalued by 10% which caused the builder to demand $ 3 million as additional compensation. North Ocean Tankers (NOT) did not agree with this claim but due to unfair threat of contract breach, additional payment was agreed to. NOT had negotiated a lucrative charter for the proposed tanker and thus could not afford any delay in delivery. However, after nine months of delivery, NOT wishes to recover the excess payment made to the builder. It is apparent from the discussion of the relevant law that economic duress is present here. This is because NOT protested against the excess payment and were not legally entitled to make the payment. However, owing to economic threat of breaching the contract in unfair manner became the enabling force of providing consent for the additional payment. In the absence of this threat, the company would surely not have made additional payment of $ 3 million as the same was not driven from the contractual obligations. Further, the forced agreement to make the excess payment by NOT effectively resulted in contractual relations. Thus, it may be concluded that revised contract was indeed voidable at the behest of the company i.e. NOT. However, in light of the verdict of the North Ocean Shipping v Hyundai Construction (The Atlantic Baron)[1979] QB 705, the company i.e. NOT would not be able to recover the excess payment of $ 3 million as the delay in demanding the same has effectively led to c onfirmation of contract. Conclusion It can be concluded from the above discussion, that the revised contract with the excess payment clause was voidable at the behest of the company but due to the delay in making the demand for recovery of this payment, the payment becomes irrecoverable. In case, the recovery process could have been initiated earlier, the company may have succeeded in recovering the excess payment of $ 3 million. Terry Fox Terry Fox In Canadian history there are many famous people. In my mind one really stands out among the rest. His name is Terry Fox and he is one of the greatest athlete to run on the face of this planet. Terry discovered he had cancer and then decided to run across Canada. He was a brave man who would take what the world through at him. Running across Canada was his way to show the world that he was not going out with out a fight. Terry Fox was born in Winnipeg Manitoba on July 28 1958 Terry was raised in port Coquintlam, British Columbia. He was very athletic from a young age. When he was in grade eight Terry was rated nineteen out of nineteen on his basketball team. For that first season he was on the court for approximately one minute. This did not affect Terry and did not let it get to him, fore just two years later Terry was the starring player on his team. By the time he graduated he became one of two athletes to receive the schools highest athletic award. Terry knew that aches and pains are common in athlete's lives. At the end of his first year of university there was a new pain in his knee. One morning Terry woke up to see that he could no longer stand up. A week later Terry found out that it was not just an ache he had a malignant tumor; his leg would have to be cut off six inches above the knee. Terry's doctor told him that he had a chance of living but the odds were fifty to seventy percent. He also said that he should be glad it happened now fore just 2 years ago the chance of living was fifteen percent. The night before his operation a former coach brought Terry a magazine featuring a man who ran a marathon after a similar operation. Terry didn't want to do something small if he was going to do something he was going to do it big. "I am competitive" Terry said, "I'm a dreamer. I like challenges. I don't give up. When I decided to do it, I knew it was going to be all out. There was no in between Terry's sixteen month follow up he saw all the young people suffering and getting weak by the disease. He never forgot what he saw and felt burdened to thoughts that died to run this marathon. He was one of the lucky one in three people to survive in the cancer clinics. Terry wrote asking for sponsorship" I could not leave knowing that these faces and feelings would still be here even though I would be set free of mine, somewhere the hurting must stop... and I was determined to take myself to the limit for these causes." Terry got back into sports and joins a wheelchair basketball team. He took on his new challenge as he usually had. Terry made himself strong by pushing his wheel chair. He would push himself along the sea wall of Stanley Park in Vancouver or find a steep mountain of a log road and would go to his hands bled. Two years after Terry stated his training to run, so nobody could see him he ran his first half-mile in the dark. For fifteen months of training and after running 3159 miles his stump was raw and bleeding. Terry ran 101 days everyday he ran 23 miles a day and only stopped for Christmas because his mother asked him. Terry was always determined. One day when his artificial leg broke he hitchhiked home and fixed his leg and ran another 5 miles. He told his mother about his journey to run across Canada his mother told him he was crazy but when she told his father he simple asked "When?" Terry received his sponsorship and on April 12 1980 he dipped his artificial leg in the Atlantic ocean of the coast of St. Johns Newfoundland, there he began to run the greatest Adventure of his life, "I loved it," Terry said. " I enjoyed myself so much and that was what other people couldn't realize. They thought I was going through a nightmare running all day long. People thought I was going through hell. Genetically Engineered Organisms Without vigorous experimentation or public consent genetically modified foods have been introduced into our daily kitchens without much notice from the general public. Widespread use of genetically modified (GM) seeds began in 1996 and since then has spread to cover 167 million acres around the world; two-thirds of that quantity being in America (Figure 1). Figure 1 Monsanto is the main developer of these seeds and controls over 90% of the American market, alerting a possible crisis in the democratic system. (Cummins and lilliston, 2004). Alarmingly, some of the largest biotechnological companies have also introduced toxic pesticides into our environments, including but not limiting to: Agent Orange, DDT, and PCB’s, causing much worry worldwide. This report will cover the basics of genetic engineering, genetically engineered seeds, possible effects on human health and affects on the environment. The four most common genetically engineered (GE) crops grown on a commercial scale are soybeans, corn, cotton and canola. Among these, two main traits have been added: herbicide resistance (75 percent of all GE crops), pesticide resistance (17 percent) or both (8 percent), (Genetically Engineered Food, Page xiv). The first steps in genetically modifying organisms is identifying the trait you want the plant to have, and finding another organism that has it. Then, the gene can be inserted into the plant using a 22-caliber charge that fires a metal particle coated with DNA, called a â€Å"gene gun†. Another method of inserting the desired gene includes heating the seed and placing it under stress causing it to be susceptible to a bug called Agrobacterium tumefaciens. The CIO is the most important person within an organization in regards to the collecting, organization, monitoring and securing of data. The CIO is a critical member of the executive leadership team. Charged with developing the organization’s strategy, he or she is responsible for leading the IT staff and ensuring overall compliance with all regulatory requirements. The CIO is also responsible for keeping up-to-date with the latest technology trends as well as threats and being able to adapt the organization’s strategy to mitigate those threats. The CIO also facilities and drives change within the organization (Glaser & Williams, 2010). The CIO is responsible for establishing and maintaining many key relationships within an organization’s leadership team. They work to provide valuable input that helps shape the entire organization’s vision and path to success. The CIO reports consistently on the progress and development of all information technology (IT) projects, issues, and tasks. â€Å"They are the brain of the business-body, monitoring and regulating all the data that passes through. Without CIOs, a healthcare company would collapse under the weight of unprocessed information.† (Becoming a Healthcare CIO (Chief Information Officer), 2012) The CIO focuses on updating and optimizing existing systems while utilizing new systems effectively and efficiently. They are also responsible for updating and maintaining capabilities, strengthening policies and reworking procedures on a daily basis. The CIO is the front line of defense for protecting the organization against fraud and abuse, as well as securing all electronic patient health information (ePHI). The role of the CIO has evolved as the health care industry has faced changes with the dependency on  information technology. Figure 1.
